GuideVest Terms of Use

1. Acceptance of Terms

By using GuideVest (“Service”), you agree to these Terms of Use. If you do not agree, do not use the Service.

2. Educational Purpose Only – No Financial Advice

GuideVest is an educational tool only. We do not offer investment advice or recommendations. All information and AI insights provided are for educational purposes. You alone are responsible for your financial decisions. Please consult a licensed financial advisor before making investment decisions.

2.1. Paper Trading & Virtual Money

GuideVest offers paper trading features powered by Alpaca Securities LLC. Paper trading uses virtual money only ($100,000 simulated balance) and has no real financial impact. Paper trading is for educational and practice purposes. Real money trading requires separate account setup, identity verification (KYC), and compliance with securities regulations.

  • Paper trades execute using real market prices but no actual money changes hands.
  • Your paper trading balance, positions, and performance have no real-world financial value.
  • GuideVest is not a broker-dealer. Real money trading (if enabled) is executed through Alpaca Securities LLC (Member FINRA/SIPC).

2.2. AI Image Uploads for Analysis

GuideVest Premium users may upload screenshots of stock charts or financial diagrams for AI-assisted educational analysis, up to a maximum limit of 40 images per user per month. Images uploaded are analyzed in real-time using OpenAI's API. You represent that you have all rights and permissions to upload any images. GuideVest does not claim ownership of uploaded images and uses them solely for context in your educational chat session.

3. Eligibility and Age Restriction

You must be at least 18 years old to use GuideVest. By using our Service, you confirm you meet this age requirement and have legal capacity to agree to these Terms.

4. Account Registration & Security

  • Provide accurate, complete information when creating your account.
  • Keep your credentials safe. You’re responsible for all activity on your account.
  • GuideVest is not liable for loss due to account misuse or unauthorized access.

5. Subscriptions, Free Trial & Payments

  • Certain features require a paid subscription. You may be eligible for a free trial. After your trial, your subscription will auto-renew unless you cancel before the trial ends.
  • By subscribing, you agree to recurring charges unless canceled before renewal.
  • All subscription fees are non-refundable except where required by law.
  • You can cancel anytime; you will keep access until the end of the current billing period.
  • GuideVest uses Stripe for payments. We are not responsible for third-party payment errors.

6. Service Availability, Disclaimer & Limitation of Liability

  • GuideVest is provided “as is” and “as available”. We make no guarantees of accuracy, reliability, or availability.
  • Service may be interrupted, suspended, or discontinued at any time. We are not liable for any loss, damage, or inconvenience due to downtime, outages, or errors.
  • To the fullest extent permitted by law, GuideVest and affiliates disclaim all liability for indirect or consequential damages, lost profits, or lost data.

7. User Conduct

  • No unlawful, fraudulent, or abusive use of GuideVest.
  • Do not copy, distribute, or exploit our Service or content without permission.
  • We reserve the right to suspend or terminate your access at any time.

8. Modifications to Service or Terms

We may change, update, or discontinue the Service or these Terms at any time. Updated Terms take effect immediately upon posting. Continued use means you accept the changes.

9. Intellectual Property

GuideVest’s content, branding, and intellectual property are owned by GuideVest or its licensors. Do not use or reproduce our materials without written consent.

10. Third-Party Services

GuideVest uses third-party providers including OpenAI (AI insights), Supabase (authentication & database), Finnhub (market data), Stripe (payments), and Alpaca Securities LLC (paper trading). We are not responsible for external service availability, privacy, or errors.

  • Alpaca Securities LLC: Paper trading and (if enabled) real money trading. Subject to Alpaca's terms and conditions. Member FINRA/SIPC.
  • OpenAI: AI-generated insights and chat. Subject to OpenAI's usage policies.
  • Finnhub: Real-time market data. Subject to Finnhub's data policies.

11. Governing Law & Jurisdiction

These Terms are governed by Texas law. Disputes will be handled in courts in El Paso County, Texas, USA.
